Supreme Court Questions Umar Khalid Bail Denial, Says UAPA Bail Rule Was Not Properly Applied

The Supreme Court on Monday expressed serious reservations about its January 2026 order denying bail to former JNU student leader Umar Khalid in the Delhi riots conspiracy case. A bench of Justice BV Nagarathna and Justice Ujjal Bhuyan said the earlier ruling failed to properly apply the 2021 KA Najeeb judgment, which allows bail in UAPA cases involving prolonged incarceration and delayed trials. The court warned against turning pre-trial detention into punishment and reiterated that “bail is the rule, jail is the exception” even under UAPA. Khalid has remained in jail since September 2020 over alleged conspiracy charges linked to the 2020 Delhi riots. (PC: India Today)
